Police Should Enforce Laws, Not Complain About Them

On Monday, I wrote about angry cop Jim Carnell, who attacked Massachusetts voters for supporting marijuana decrim. Yesterday, Boston Herald ran this response from NORML’s Paul Armentano:

Am I the only one who is troubled to learn that a public servant like Jim Carnell has such a low opinion of those he’s paid to protect ("Everybody musn’t get stoned," Nov. 8)?

According to Carnell, those 2 million Bay Staters who decided in favor of Question 2 are “starry-eyed nitwits” and those 100 million Americans who have ever tried pot are "cretins."

And the author’s home state is a national "laughingstock" because its voters enacted common sense pot policy that is nearly identical to the laws in Mississippi and Maine. Sorry Jim, but the joke’s on you!

It’s true and the more I think about it, the more crazy Carnell’s rant really is. He all but wishes out loud for the new policy to cause problems. Ideally, the law will work well, and even police should be hoping for a positive outcome, right?

If it turns out that marijuana decrim doesn’t create major problems, then everybody wins. And I’m quite sure that’s exactly what will happen, so long as Jim Carnell and his colleagues don’t find a way to screw this up.

Are Public Servants *Really* Public Servants

The Government works for us. We pay their salaries. When "we, the people" say jump the only proper responses for them are to either jump or ask how high?

That's high school civics. But we all know the real world doesn't work like high school civics. In reality, government employees--both elected politicians and appointed bureaucrats--often have their own agendas. With their proximity to the levers of power, they can implement their own agendas--even if they're in direct contradiction to the will of the people.

We're about to have a test of whether we are a banana republic or whether the state of Massachusetts is an orderly, law-abiding, democratic government.

If the agents of the state, the cops, take their duties seriously, they will issue civil citations and that will be all. If they find a work-around to haul people down-town, scare them, detain them in a holding cell before issuing a citation, or plant marijuana on them, we'll know that something is very wrong in the Bay State.

Here's the question:

Will the police follow the law?

I suspect they will. But we must remain vigilant. . .

When I was a kid

The whole situation with that cops rant reminds me of when i was a kid, getting arrested for curfew violations, and flipping out about how its bogus that I have to pay for the tickets because I was out to late. I ranted on and on to my parents and all they could say is, "we don't make the laws and you have to abide by them" I would love to see that cop on the street and tell him the same thing my parents told me, "You don't make the laws, if you don't like them then move out!!" Hes prolly just pissed because hes losing his overtime pay for busting potheads. Its interesting to see that since it wont take him 4 hours to ticket a pothead hes actually going to have to resort to arresting real criminals.

Carnell is a Public Figure

Not only are police officers public servants, they’re also public figures, meaning their right to privacy is diminished and they have fewer defenses in cases of  purported libel or slander.

Part of Officer Jim Carnell’s job as a public figure is public relations.  He’s obviously failed miserably in that critical capacity.  The tongue lashing he’s given to Massachusetts voters may not get him suspended, but I doubt he’ll be promoted to any higher rank or position in the police department in the future.  Free speech may be free, but it can still have consequences.

The puzzling aspect of all this is Carnell’s emotional involvement regarding little ol’ marijuana.  If someone changed a few zoning laws, it probably wouldn’t make much difference to Carnell.  But something about cannabis just sets him off—to the potential detriment of his own career.  Truly strange.  If we could better understand this kind of knee-jerk phenomena at a clinical level, we would be closer ending drug hysteria and thereby the drug war.

Well said Giordano. The other thing I think we need to work on is their "save the kids" garbage. I have 4, and want my kids to be good productive citizens when they grow up. I'd rather have any of them (especially my girls) take a couple of tokes than to drink alcohol. I also want them to know the FACTS about each drug so that they can make good decisions. Seems like the ONDCP only cares about pot. They could care less about the terrible crack, meth, and opiate addictions. At least that's what one would think looking at what they put out in the media and in advertisements.

Back to my point, I even heard some numskull on the Fox channel last night talking about how Obama's interaction with Ayers etc. was "sending our kids the wrong message and teaching them to make bombs". Even post-election they still can't leave Obama alone on a dead horse issue. SO - the other thing I think we need to figure out is a way to deal with their spin that all this anti-pot ranting is to "save our kids". That's bull.

The best thing they can do is get the FACTS, even those they disagree with, and teach them to our kids. They can also grow up and enter the 21st century in regards to pot. Making laws about pot that reflect reality sends our kids the best message.

They also can't change the minds of MILLIONS of us because we KNOW what pot really is and what it REALLY does.

There are a couple of words in here that may get flagged in their anti-terror text search programs, so maybe some of them may get the message.

Thank you, Giordano, for this sensible take on Officer Carnell's illogically biased position and for your suggestion of clinical analysis, which implies that therapy could be called for. I recommend mental sick leave for Officer Carnell.

Think Simplicity

This comment is relevant to our efforts in general, so I apologize if you find this comment off-topic, hoping you will still take a moment to read and think about it.

To defeat our opponents, we all must first understand their vulnerabilities.

Their main vulnerability is the need to publicly lie.

We need to focus sharply on this vulnerability.

How?

Every time a proposed change in the law to reduce or eliminate penalties relevant to drug use comes along, prohibitionists publicly proclaim disaster if the change happens.

Since a number of proposed changes have been implemented, surely prohibitionists have evidence backing up their proclamation that a disastrous shift results from such law changes.

Every time a prohibitionist publicly states the same proclamation, we should simply, nicely, publicly invite the prohibitionist, who certainly can only gain by sharing such evidence, to back up the proclamation by publicly providing such evidence.

As Mark Twain said, "If you always tell the truth, you don't have to remember anything."

Prohibitionists have a lot to remember. Let's constantly use their lies against them to publicly eliminate their credibility.

Focus is key, and the reform movement, with tremendous respect for the hard work done, lacks focus.

Without this focus, we dilute ourselves.

The public majority needs simplicity. All we need to do is nicely repeat the invitation. This method of opposition is as simple as it gets.

Focus everything on this invitation, and victory will be ours soon.

This whack is the problem nutshelled

Anyone with any experience or intelligence--or who is even willing to take the time and look at the existing research--knows weed is for all practical purposed harmless and its illegality a victimless crime. Those who make their living off of its illegality, however, are having to face the realization that what they declared war on, what they despise, is actually harmless, even beneficial, and used by millions in this country alone. This is like telling a man his god is a devil.

Many countries in Europe have illegal cannabis on the books. There are comparatively no arrests though because the cops on the beat look the other way. This is what needs to happen here, but will not as long as ignorant people such as this man can spread their pompous ignorance. For an authority figure such ignorance is very dangerous.

And I agree. If they had to go after real criminals, who put up resistance...or who fight back, perhaps this thing would take a different turn.

I encourage everyone to write to President Elect Obama as I have. It is my belief he is still a bit in the dark about this fight...and also unpunished for smoking serious reefer in college.

How in good conscience can he allow anyone punished for what he did? Or Schwarzennegger? Or the half of Congress that likes to brag about "those days" when they smoked? For their giggle of experience, another man has lost his job, did some time, and obtained a criminal record. This is hypocrisy defined.

TO SERVE AND PROTECT

This policeman should be fired,he not there to set policy and admonish the taxpayers that pay to put bread on his table ,only to enforce laws that the peoples representives make.Why has he not been fired?
Mass. residents should demand this!
One more thing , did anyone hear that john kerry and gov.deval were against this law that was passed by the majority of mass. residents?
and if so should these two democrats be grilled on who they really represent?

New York decriminalized user amounts of pot decades ago

In New York, neighbor to Massachusetts, possession user amounts of cannabis (under about 7/8 oz) is a violation -- equal to a parking ticket and not a crime. This has caused no problem whatever. Surely Officer Jim Carnell is aware of these facts. Or is he?
